In general, most people don`t understand what it means to be legally separated. They believe it`s the same as a divorce. Ohio`s family laws state that they are different. Therefore, a legal separation can cost you more time and money if you later decide to file for divorce. To be legally separated, a registration fee must be paid, which varies depending on the county where the petitioner lives. For example, Summit County has filing fees ranging from $300 to $360. Generally, it is not necessary to work with a law firm to be separated. However, the court may require both spouses to do so in the case of children.

In this way, child support and custody can be determined, and everything is considered fair. Divorce is the most common way to legally end a marriage. This takes longer than a resolution – usually between four months and a year after submission. You and your spouse do not have to settle the terms of the divorce before filing it. You don`t have to agree everything with your spouse. If children are present and the couple cannot stay together, custody, child support and a parenting plan are necessary. Although both parties live separately and accept separation orders, it is not a dissolution of marriage, regardless of the country in which they live. The bottom line is that legal separation in Ohio keeps your marriage legally intact. Meanwhile, the marriage ends in the event of divorce or dissolution of the marriage in Ohio. However, the issues dealt with by the court in a final decision or agreement on legal separation in Ohio are the same as those dealt with in a divorce or dissolution of marriage in Ohio. This may include parental rights, child support, spousal support, division of property, and payment of debts. It is important to remember that the rights and obligations established in legal separation can be enforced before the courts. A dissolution is sometimes considered an “undisputed” way to end your marriage. You and your spouse must agree on all the parts of what will happen after the marriage ends – child custody and visitation, child support, spousal support, division of your property and debts, and everything else. They must both appear at a hearing. The path to most divorces begins with a separation.
